Under the Russian Laws if you use the surrogacy services and/or the services of a donor of sex-associated cells, You fall within the Russian jurisdiction where surrogacy is allowed, and not within the jurisdiction of Your country.
1.Legislation bases concerning citizens’ health as of 22.06.93 N 5487-I Article 35 of the Legislation Bases provide for the following: * The right of every adult woman in the genital age to artificial fertilisation and embryo implantation * The right of every woman to obtain information concerning the procedure of artificial fertilisation and embryo implantation and their consequences * The right of every woman to obtain information concerning medical-genetic examination, appearance and nationality of the donor * The obligation of the spouses or a single woman to provide a written consent to the Auxiliary Reproduction Procedure; information about procedure and donor’s personality shall be kept under seal of secrecy.
2.The Russian Federation Family Code as of 29.12.95 N 223-ФЗ Articles 51 and 52 of the Family Code provide for the following: * People who are married and who have given their written consent to the application of the artificial fertilization method or to embryo implantation will be registered as parents of the baby who will be born as a result of such a procedure * People who are married and who have given their written consent to implant the embryo into another woman for the purposes of their baby’s carriage can be registered as his/her parents only if the woman who bore the baby (a surrogate mother) gives her consent.
3.The Federal Law "About Civil Status Acts " N 143-ФЗ as of 15.11.1997 states that: * A single woman who gives birth to a child owing to insemination or IVF (with donor’s sperm/ with donor’s ovocytes and donor’s sperm) shall register the baby as his/her mother according to the normal procedure, as if it were a normal pregnancy * A couple that has used IVF and/or donor program shall register their newborn child according to the normal procedure. Meanwhile the parents shall not attempt to identify the donor, and the donor shall not attempt to identify the recipient and/or look for the baby that was born as a result of his donor’s material use * A couple that has used the "Surrogacy" program in accordance with Article 16 of the Law shall at the child’s birth registration provide a document, issued and certified by the medical organization confirming consent of the woman who gave birth to the child (a surrogate mother) to child’s registration by his parents together with the document confirming the child’s birth.
